1. Agreement to Terms
To use Phocam ("the App"), you must agree to these Terms of Use. If you do not agree to these terms, you may not use the App.
2. Service Description
The App provides a service that allows users to overlay selected images as photo cards on photos taken with their camera.
3. Image Rights
Users are responsible for confirming, at their own responsibility, that they own or have proper authorization for all images used in the App, including copyright, image rights, and other intellectual property rights. Users bear all responsibility for any issues arising from the use of images that infringe third-party rights.
4. Prohibited Conduct
You agree not to engage in any of the following while using the App: - Infringing the copyright, image rights, trademarks, or other rights of third parties - Violating any applicable laws or public order and morals - Reverse-engineering, decompiling, disassembling, modifying, or otherwise analyzing the App, except to the extent expressly permitted by applicable law - Interfering with the operation of the App, or causing harm to the developer or any third party - Redistributing, reselling, or leasing the App for commercial purposes
5. Disclaimer
Use of the App is at the user's own responsibility. The App is provided "as is," and the developer makes no warranties of any kind regarding fitness for a particular purpose, completeness, or accuracy. Except in cases of the developer's willful misconduct or gross negligence, the developer is not liable for any damages arising from the use of the App, including but not limited to photo capture/save failures or loss of photo card data. The App's services may be changed or terminated without notice.
6. Changes to Terms
The developer may modify these terms at any time. Modified terms become effective when posted on the App or related website. Where significant changes are made, the developer will make reasonable efforts to provide advance notice.
7. Governing Law
These Terms of Use shall be interpreted and applied under the laws of Japan.
